The District Consumer Commission in Dehradun has ruled in favor of Praveena Sati, a resident of Dehradun, in a case against New India Insurance Co Ltd (NIICL). The case involved the accidental death of Praveena’s husband, Sudarshan Sati, who died in a car accident on February 10, 2021, when his car plunged into the Asan Barrage near Vikas Nagar. Sudarshan had insured his car with NIICL, but the company rejected the claim, citing that the driver, Priyanshul Rangad, was under the influence of alcohol at the time of the accident.

However, after reviewing the police investigation report, relevant papers, and hearing both parties, the commission found no evidence to support NIICL’s claim. The commission, comprising Presiding Officer Pushpendra Khare and Member Alka Negi, concluded that NIICL was deficient in its service. The commission noted that there was no medical report confirming that Rangad was drunk, and no police action was taken against him for negligent driving, which ruled out his involvement as the driver at the time of the incident.

As a result, the commission ordered NIICL to pay Rs 15 lakh to Praveena, the nominee, along with 6% annual interest from the date the complaint was filed, November 26, 2021. Additionally, NIICL was directed to pay Rs 25,000 for mental agony and litigation costs. The commission’s decision highlights the importance of insurance companies providing fair and timely compensation to policyholders and their families in the event of an accident or death.

The case also underscores the need for insurance companies to thoroughly investigate claims and provide evidence to support their decisions. In this instance, NIICL’s rejection of the claim was found to be unjustified, and the company was held liable for the compensation. The commission’s ruling provides a sense of closure and financial support to Praveena and her family, who had been seeking justice and compensation for the loss of their loved one.
