The Bombay High Court has stayed a single bench order that imposed a cost of Rs 4.5 crore on Patanjali Ayurved Ltd for violating an ad-interim order restraining the company from selling camphor products that infringed Mangalam Organics Ltd’s trademark. The single bench had earlier held that Patanjali had intentionally flouted the court’s order and imposed a cost of Rs 4 crore. The court had noted that Patanjali was a “very wealthy company” and could not be permitted to go “scot-free”. The company had been directed to deposit Rs 50 lakh, which would remain with the court during the appeal. The litigation started when Mangalam filed a suit against Patanjali alleging copyright infringement of their camphor products. The high court had earlier prohibited Patanjali from selling or advertising the camphor products, but the company continued to do so, leading to the imposition of the cost.
