HCL Corporation Pvt Ltd, a promoter company of the HCL Group, has obtained a temporary injunction from the Delhi High Court against Healthcare HCL Reference Laboratories and others for trademark and copyright infringement. The plaintiff owns the ‘HCL’ trademark and its variants, which it adopted as an acronym from Hindustan Computers Limited. The plaintiff alleged that the defendants are using its trademarks without permission, including on their website and social media pages. The court observed that the defendants’ actions are mala fide and aim to strike a false association with the plaintiff’s services. The court also noted that the defendants are using the plaintiff’s trademarks in the same color combination and have not complied with a cease and desist notice. The court restrained the defendants from using the HCL marks until the next hearing and directed them to take down any content related to the impugned marks. The matter is listed for further hearing on March 25, 2025. The court also issued summons in the main lawsuit.
